1. "The Closers" agree to accept leads generated by "Member" for the purpose of engaging in
CLOSING
SALES FOR MEMBER
in the Closing Center and Coastal Vacations, on a
BEST EFFORTS BASIS
.
Form Fills from Member's Site will be worked by The Closers once Member enters the Form Fill into their Back Office, with no further action required by Member. All other leads from ANY SOURCE unless specifially listed as exempt, must be PRE-STAGED by Member to have Lead fill in the Form on their site indicating willingness to have The Closers contact them. If Member elects NOT to PRE-STAGE the lead(s) The Closers will still contact them, but a 10% Pre-Stage Fee will be deducted from Member's Pay to offset the additional time and effort required. MARKETING ASSOCIATES must "Pre-Stage" (make first call) to ALL LEADS first.
2. "The Closers" shall work Members Leads until it is determined such Lead(s) are "Dead" due to No Funds Available (NFA), Absolute Refusal (AR), or Lead is
SOLD AND ENROLLED
in The Center under one of the then existing
START UP OPTIONS for a period up to and including the end of any Membership Term.
3. "The Closers" agree to
REPORT ON ALL LEADS
to "Member" regardless of outcome or disposition of Lead, with either a
CHECK FOR THE SALE
or with the
HISTORY AND DETERMINATION
from the "Closer(s)" who worked the lead.
4. SHIPMENT OF COASTAL TRAVEL PACKAGES. Packages shipped from "The Closers" to Member, whether such package is for Member's Personal Purchase, or for a Retail Sale made by Member to be shipped to a Customer of Member, becomes the responsibility of the MEMBER ORDERING THE PACKAGE or of the Qualified Director for whom "The Closers" are transacting the sale, once the package has been shipped and a tracking number has been secured.
4a. If the package(s) can be INSURED or if the shipping method is Federal Express or UPS, "The Closers" will do everything within our ability, to track and see that DELIVERY takes place as expected. However, in the event of an UNRECOVERABLE SHIPMENT, ownerhip and responsibility of REPLACING the lost package, falls to the DIRECTOR RECEIVING MEMBER PAY on that sale or the PURCHASER of the package if said package was ordered as a Retail Sale. "The Closers" are only the TRANSACTING AGENT in package purchases and will provide PROOF OF SHIPMENT. However we retain no revenue on packages and bear no responsibility for DELIVERY of packages shipped, beyond securing Insurance Reimbursement, or tracking when possible.
5. "The Closers" agree to
RELEASE FUNDS FROM SALES
upon funds tendered to "The Closers"
CLEARING
to "The Closers" bank account and after a minimum of
THREE (3) DAYS
has passed from the Date Of Sale to allow for any possible reversal of Sale. Pay will be sent weekly. Pay is FORFEITED AFTER 90 DAYS if we are unable to pay Member due to lack of a payment method and cannot contact Member.
6. "Member" agrees to apply their "Best Efforts" to promote "The Closers" by purchasing leads, advertising,
using co-ops, emailing and any other means readily available within "Members" financial and personal abilities.
7. "Member" agrees they will
NOT
use any deceptive, illegal or other misleading methods to promote "The Closers" in their promotion efforts, including but not limited to: SPAM, converting of funds to personal use, lieing, cross-line sponsoring of any existing Coastal Masters Group or "The Closers" Members or any other act that would be deemed by reasonable and prudent business people as violating good and honest business practices. Violation of this Term results in Immediate Canceling and Forfeiture of Leads and commissions.
8. "Member" agrees if they live inside the United States, before they can receive any checks or payments from "The Closers" they will have on file with "The Closers" their
Social Security Number and a current W9 Tax Form
to allow "The Closers" to make valid Commission Payments to "Member."
